A San Jose State volleyball coach was suspended after she complained against a transgender player Blaire Fleming, Daily Mail stated. Coach Melissa Batie- Smoose alleged that the school tried to 'silence' her after she was suspended from her activities. 'This is just another form of what San Jose State has been trying to do-silence people that are speaking up for their First Amendment rights and for what's right,' she told Outkick. Several opponents refused to play against the San Jose State team because of concerns regarding Fleming who is a male biologically, Daily Mail reported. Fleming currently faces a class-action lawsuit against the National Collegiate Athletic Association, which was accused of purportedly breaking laws that forbid gender-based discrimination, by allowing them to participate in women's sports. Amid Fleming's controversy, the coach of volleyball at San Jose State-Batie-Smoose, filed a Title IX complaint this week accusing that school authorities showed an act of partiality towards them 'at the expense of Fleming's 18 female teammates,' Quillette reported. Batie-Smoose's complaint also alleged that Fleming had met with Colorado State University' s Malaya Jones before a match in Fort Collins on October 3. She claimed the pair made up a plan to leave the center of the court open so that Jones, 21 could target Brooke Slusser , San Jose State vice-captain with powerful 'kills' for being against her inclusion in the team, Daily Mail stated. She was believed to do so after Slusser mentioned it was unfair and not safe to play alongside a transgender co-player. The San Jose State confirmed to Outkick that Batie-Smoose was suspended by the team, however they did not provide any official reason. The San Jose State team players were informed about the suspension just before their game against New Mexico.
